Kapoko’s continued trial set for Sept 16

LUSAKA magistrate Exhonobit Zulu has set September 16, 2009 as the date for continued trial in a case where former Ministry of Health human resources manager Henry Kapoko and eight others are charged with offences ranging from theft to obtaining money by false pretences.

Kapoko and the others yesterday appeared for mention before magistrate Zulu who then set September 16 as the date for continued trial in the matter.

Taking plea before another court, Kapoko pleaded not guilty to a charge of obtaining money by false pretences contrary to Section 309 of the Penal Code Chapter 87 of the Laws of Zambia.

Facts before the court were that Kapoko, on an unknown date but between January 22, 2009 and February 28, 2009 in Lusaka whilst acting together with other persons unknown with intent to defraud the Ministry of Health of K1.9 billion, falsely pretended that he had ordered and shipped 50,000 mother-baby kits when in fact not.

Kapoko denied the charge and the court entered a plea of not guilty. In another matter, Kapoko is facing other charges with other persons.

Ministry of Health director of health policy, Dr Chrispine Sichone, 44, has been charged with six counts of theft by public servant involving K4,370,825,000.00 while Roy Maswenyeho, 56, of house number C5 Chabisa Road, Woodlands, Lusaka, who is a principal accountant at the Ministry of Health, was charged with two counts of theft by public servant amounting to K1,115,618,850.00.

Vincent Luhana, 35, a senior accountant at the Ministry of Health and of plot number 551, Avondale in Lusaka was charged with six counts of theft by public servant amounting to K4,088,389,186.00.

Evaristo Musaba, 47, a former chief accountant at the Ministry of Health and now with the Accountant General's office, Ministry of Finance and of house number 213, Monkey Close, Ibex Hill was arrested and charged with four counts of theft by public servant amounting to K2,151,527,286.00.

Kapoko was again arrested and charged with five counts of theft by public servant and five counts of theft amounting to K6,840,547,636.00, while Nobert Peleti, 39, an assistant director of administration at the Ministry of Health and resident of plot number 2749 Shantumbu Road, Chilenje South was charged with five counts of theft by public servant amounting to K3,098,751,486.00.

Kaoma Zukas Kaoma, 38, acting Ministry of Health principal accountant and a resident of plot number 2344, Lilayi, Chipwepwenu area, Lusaka was charged with nine counts of theft by public servant amounting to K6,342,997,636.00.

Algonquin director Naomi Gladys Musopelo Chawinga, 51, a resident of house number 11/12 Shimaponda road, Matero East, was charged with ten counts of theft amounting to K6,840,547, 636.00 while 27-year-old Algonquin Management Consultancy shareholder and resident of plot number 65 Makishi road, Northmead, Lusaka, Masuzyo Kuma Chawinga, was arrested and charged with six counts of theft amounting to K4,017,197,800.00.

The matter comes up for continued trial on September 16.
