Court adjourns Post journalist assault case

TRIAL in a case where MMD Lusaka province youth chairman Chris Chalwe is alleged to have assaulted two journalists was yesterday adjourned for the third time since it commenced.

Prosecutors in the matter applied for the adjournment to December 14, 2009 because the court could not sit and proceed with the matter as the magistrate handling the case was preparing to leave for a workshop out side the country.

In this matter, Chalwe, 42, is facing two counts of assault occasioning actual bodily harm contrary to section 248 of the Penal Code Chapter 87 of the Laws of Zambia.

In count one, Chalwe is alleged to have assaulted Post journalist Chibaula David Silwamba.

Particulars of the offence are that Chalwe on July 29, 2009 in Lusaka assaulted Silwamba, thereby occasioning him actual bodily harm.

In count two, Chalwe is accused of having assaulted Times of Zambia senior reporter Anthony Mulowa.
Facts before court are that Chalwe on July 29 in Lusaka did assault Mulowa, thereby occasioning him bodily harm.

Chalwe pleaded not guilty to both counts.

Both Silwamba and Mulowa have testified in the matter since trial commenced about three months ago.

The matter comes up on December 14, 2009 for continued trial.
