MMD’s Chalwe found with case to answer in journalists assault case

LUSAKA senior resident magistrate David Simusamba has found MMD Lusaka Province youth chairman Chris Chalwe with a case to answer in a matter where he is charged with two counts of assault.

Magistrate Simusamba put Chalwe on his defence. The state called a number of witnesses to testify in the matter. This is in a matter where Chalwe is facing two counts of assault occasioning actual bodily harm contrary to Section 248 of the Penal Code Chapter 87 of the Laws of Zambia.

In count one, Chalwe is alleged to have assaulted Post journalist Chibaula Silwamba. Particulars of the offence are that Chalwe on July 29, 2009 in Lusaka assaulted Silwamba, thereby occasioning him actual bodily harm.

In count two, Chalwe is accused of having assaulted Times of Zambia senior reporter Anthony Mulowa.
Facts before court are that Chalwe on July 29, 2009 in Lusaka District did assault Mulowa, thereby occasioning him bodily harm.

Chalwe pleaded not guilty to both counts.

Ruling on whether Chalwe had a case to answer or not yesterday, magistrate Simusamba said he had considered the evidence before court and was satisfied that the state had established a prima facie case against Chalwe.

“Upon consideration of the prosecution evidence and upon consideration of submission by the defence councils, I am satisfied that a prima facie case has been established and I put you on your defence,” magistrate Simusamba said.

Defence in the matter has been set for August 5, 2010.
