Magistrate orders Radio Liseli to compensate ULP's NyambeBy Nyambe Muyumbana in Mongu

MONGU Principal Resident magistrate Bernard Mwanandiwa has ordered Oblate Radio Liseli in Mongu to pay United Liberal Party (ULP) national deputy chairman for elections and campaign, Lawrence Nyambe, K30 million for damaging his reputation.
This was a case in which Nyambe sued Oblate Radio Liseli as first defendant and ULP Western Province spokesperson Teddy Chimbinde 46, as second defendant for defamation of character. Facts before the court were that on January 31 and February 1, 2008, Oblate Radio Liseli aired news broadcasts both in Silozi and English, saying that Nyambe was promised to be given a cow by Kalunga Mulandula, a losing ULP candidate in last year’s by election in Liuwa, if he was to be adopted.
The news broadcast further said that after contacted for a comment, Nyambe refuted the allegations saying that he was not promised a cow by Kalunga if he was to adopt him. The story also quoted Teddy as saying that no one was allowed to speak to the press concerning party matters apart from himself and the party provincial sectary Kufekisa Mwananyanda.
Nyambe contended that the broadcast was defamatory and was meant to tarnish his name in the public’s eyes because he was not promised a cow by Mulandula so that he could be adopted as ULP Liuwa candidate.
In delivering judgment, Mwanandiwa said he was convinced with the evidence produced before the court confirmed that Oblate Radio Liseli did air the defamatory news broadcast and wondered why it did so even after the plaintiff refuted the allegations.
