PF threatens to sue ZNBC

LAWYERS representing the opposition Patriotic Front (PF) have threatened to commence legal proceedings against state-owned Zambia National Broadcasting Corporation (ZNBC) if it does not cover PF's campaign activities in a fair and professional manner.

According to a letter dated September 25, 2008 to ZNBC director general, PF's lawyers, WM Kabimba and Company stated that the PF had observed that ZNBC had discriminated the party in its coverage of campaign activities contrary to the electoral Act regulations.

"We act for the Patriotic Front which is the largest opposition political party in Zambia today. Our client's instructions are to the effect that following the announcement of the presidential by-election scheduled for 30th October, 2008, ZNBC has discriminated against the PF in the coverage of its campaign in particular the public rallies and radio programmes," the lawyers stated in a letter which was also copied to the Electoral Commission of Zambia (ECZ) chairperson and PF president. "We have advised our client political party that ZNBC as a public media institution is obliged by law to give equal and fair coverage to all political parties."

The lawyers stated that that position was supported by the electoral Act regulations, which ZNBC had ignored in favour of the ruling Movement for Multi-party Democracy (MMD).

"In view of the foregoing, unless you immediately comply with the electoral Act regulations to cover our client's campaign activities in a fair and professional manner on both radio and television, we have instructions to commence legal proceedings against ZNBC in the High Court without any further notice to seek appropriate remedies accordingly," the lawyers stated
