Court grants Kapoko K800 million bail

FORMER Ministry of Health Human resources manager Henry Kapoko has been granted bail of K800 million by the Lusaka Margistrate’s court. Ruling on the bail application this morning, Lusaka magistrate Exonorbit Zulu granted Kapoko bail on condition that he deposits immovable assets of not less than K800 million.

This is in a matter where Kapoko charged with other people is facing 10 counts of theft by public servant and theft. In this matter, Kapoko is charged with 12 other people who all pleaded not guilty to 20 counts of theft by public servant and theft involving about K6.8 billion.

The other 12 were granted bail but ruling in Kapoko’s case was deferred to a later date to enable the state prove to the court their grounds for objecting to Kapoko being granted bail.

The state had argued that Kapoko should not be granted bail because he had wanted to flee the country and that it took them 10 days to apprehend him.

But Magistrate Zulu noted that there were conflicting statements between the DPO and the witness called to tell the court how Kapoko wanted to leave the country. Based on that, magistrate Zulu granted Kapoko bail.

Magistrate Zulu also ordered Kapoko to surrender his passport, bank documents and all relevant documents to the Senior Clerk of Court.

Kapoko has also been told to be reporting to Woodlands Police Station every Friday at 10:00 hours adding that he should furnish the officer in charge with a cell number which should be accessible at all times to know his whereabouts.

Magistrate Zulu, however, emphasized that the bail granted only related to the matter before him. Kapoko remains in custody until he meets all the conditions set for his bail.

The matter comes up for mention on July 31, 2009.
