RAJAN Mahtani and co-accused David Peter Kkamalarajan Kanaganagam yesterday pleaded not guilty to a charge of obtaining credit by false pretences involving K6.5 billion. Taking plea before Lusaka senior resident magistrate David Simusamba, Mahtani and Kamalarajan denied the charge against them and the court entered plea in that respect.
In this matter, the duo is charged with one count of obtaining credit by false pretences contrary to section 312(a) of the Penal Code Chapter 87 of the Laws of Zambia.
Particulars of the offence allege that on dates unknown but between February 1, 2008 and February 29, 2008 in Ndola, Mahtani and Kamalarajan jointly and whilst acting together with other persons unknown, in incurring a debt did obtain K6.5 billion from Finance Bank by falsely pretending that money was working capital for Cladava Mining Limited when in fact not.
Mahtani, who is former Finance Bank chairman, is represented in the matter by Michael Mundashi and John Sangwa.
The court has since set January 19 and 20, 2011 as dates for commencement of trial but the matter will be mentioned on December 20, 2010.
