A Lusaka woman, Pauline Katonongo Kazembe, has sued Marks Motorways Ltd over the death of her husband.Kazembe explained in a writ of summons filed in the Lusaka High Court that her husband was employed as a driver for Marks Motorways Scania Marcopolo Bus registration number AAX 9532 up to the time of his death on November 28, 2005.
She further explained that on the date in question, her husband was at around 09:00 hours involved in road accident, 20 kilometres east of Nyimba on the Great East Road after the bus overturned.
Kazembe disclosed that her husband died on the spot.
It is against this background that Kazembe has sought the court’s intervention in claiming her husband’s benefits from Marks Motorways and damages under the fatal accident Act of 1846 to 1906.
