Minister Daka sues wife's ex-boyfriend

MINISTER of Science and Technology Peter Daka has sued a man of Lusaka's Avondale area for interfering with the enjoyment of his marriage. This is in a case before Lusaka High Court judge Thomas Ndhlovu where Daka and an employee of MTN Zambia Priscilla Musa Chikwama Daka have sued Patrick Mundundu for allegedly interfering with the quiet enjoyment of their marriage by spreading rumours that he (Mundundu) was married to Priscilla.

Daka explained in a statement of claim that sometime in 2000, Priscilla and Mundundu had a boyfriend and girlfriend relationship but in 2001, Mundundu decided to migrate to the United States of America leaving Priscilla behind. He explained that Mundundu's departure to the US marked the end of his relationship with Priscilla.

Daka narrated that in 2002, he met Priscilla and they started a relationship as boyfriend/girlfriend and cohabited. He added that the relationship went on until February 2, 2007 when Daka and Priscilla formally wedded at the office of the registrar of marriages, births and deaths at the Lusaka City Council.

Daka disclosed that he and Priscilla had been enjoying their marriage until Mundundu appeared from nowhere claiming that Priscilla promised to marry him and that she had breached a promise by marrying Daka.

He recounted that Mundundu, in pursuit of his claims, had taken Priscilla to Chelston Local Court and Lusaka Central Police but his claim was dismissed.

Daka averred that Mundundu, having been dissatisfied with the reaction of the police, went to the Boma Local Court where he sued Daka for marriage interference claiming that he was having an affair with his wife.

He disclosed that on March 30, 2007, Mundundu with no permission burst into Daka's office where he started shouting at a high-pitched voice that he (Daka) had stolen his wife.

Daka complained that he was embarrassed because of Mundundu's claims, which he described as false. He wants the court to declare that Priscilla was married to him and that she was never married to Mundundu and to grant an injunction restraining Mundundu from spreading false rumours either verbally or through text messages and emails that he is married to Priscilla.

Daka is also claiming damages from Mundundu for spreading false rumours that he was married to Priscilla.

Judge Ndhlovu has since granted the interim injunction restraining Mundundu from interfering in the quiet enjoyment of Daka's marriage.
The matter comes up on May 9 for hearing.
