UK biological terror suspect admits extortion

SOUTH African police found an AK-47 assault rifle and ammunition at the home of a terror suspect accused of threatening the United States and Britain with biological weapons, prosecutors said at a bail hearing Friday.

At the hearing, Brian Roach's lawyers said he would plead guilty to attempted extortion, but not to terror charges. They also said the 64-year-old was no longer seeking bail.

Roach is accused of sending e-mails threatening to spread foot-and-mouth disease in the U.S. and Britain unless the governments paid him US$4 million in gold coins known as Krugerrands.
Prosecutors have said police have not found evidence that Roach had the means to carry out his threats.

Roach, who owns an engineering firm outside Johannesburg and has business interests in Zimbabwe, is accused of saying in e-mails that he wanted the money to compensate white Zimbabwean farmers for land lost, and accusing the U.S. and British governments of not doing enough to help the farmers.

About 4,000 white farmers have been forced from their farms since 2000 in what Zimbabwean President Robert Mugabe calls a campaign to put more land in the hands of impoverished blacks.

South African investigators worked with U.S. and British officials on the case, and arrested Roach on February 12 after a seven-month investigation.

Roach has spent the past week in the holding cells of the Bramley police station in Johannesburg. But the terror suspect is a far cry from the gentle grandfather known by his family.

Just a few roads away from the police station, Roach's 28-year-old son, Dyllan, runs his industrial lighting business. "This came as a huge shock," Dyllan said. "We don't know what's going on, and there's talk in the family that he might have been set up."

"He's old and frail and the most gentle person," said Dyllan. "He's not what I perceive a terrorist would be like. He's never done anything like this. He's just not that kind of guy."

He said that his father was a passionate sports pilot, who owned his own plane and won a South African flying championship in his heyday. Roach and his wife have been married for 36 years and live in the exclusive K'Shane Estate on the Hartbeespoort Dam in North West province. They have four children and one grandchild.

K'Shane is also home to Roach's boathouse, where he kept a helicopter.

According to his attorney, Rod Montano, he is "the least threatening person". Although Roach is still registered as a director of Brano Industries, a company that manufactures remote-controlled doors and garage door openers, his co-director Noel Otten said he hasn't been to the company for two years.

"What I've been reading about him is not the person I knew," Otten said. "He was stubborn but not very aggressive. I was as dumbfounded as anyone else… I think he was just trying to get some cash."

But this week Otten told The Daily Maverick that Roach had a history of acting strangely and during his time at the company would sometimes withhold payments to creditors unless he received money from the company.

The Hawks are not treating Roach's threats as a joke and don't view him as the gentle old man he is described as.

"You are talking about somebody who owns a boathouse and a helicopter," said McIntosh Polela, a spokesperson for the Hawks. "He was definitely very clever. It's easy to say now that he is not capable of doing what he said he would, but we took him very seriously. He's threatened two ­countries with terrorism."

Polela said that Roach's letters and emails to the UK and US governments were monitored for six months. "We had the FBI and counter-terrorism police in the UK that alerted us to him," he said. "We had negotiations with him. He thought the people he was talking to were from the UK and the US but actually there were also people from South Africa involved.

"We became aware of who he was. He wanted the person who he believed was from the UK to rent a warehouse in Hartbeespoort, drop off the Krugerrands [South African gold coin] and leave the keys at a restaurant in the town. He picked up the keys and we started monitoring him."

According to the charge sheet, Roach's reason for his demands was that he wanted to raise money for farmers in Zimbabwe, whose plight was being ignored by the West.

But Dyllan said that his father had little to do with Zimbabwe and was not born there, as many press reports have claimed and the Hawks believe. "He was born in South Africa. What the press has been reporting is way out."

Polela said: "We don't know what to make of this stuff about Zimbabwe. We know he's an ex-Rhodesian. But the story about Zim came up only after he was arrested. All he said was that he was going to release this disease."

Meanwhile, his son said that the family, and especially Roach's wife, were "taking it very badly". "There's just no way. There's no chance," he said.

MIKE Mulongoti says he is ready to lose his ministerial job for defending democracy in the MMD. And well-placed sources in the MMD have disclosed that President Rupiah Banda wants George Kunda to win the MMD vice-presidency because he is more loyal than Mulongoti.

Reacting to President Banda’s support for Vice-President Kunda, MMD vice-presidency aspirant Mulongoti, who is also works and supply minister, said those who were in authority should show loyalty to those who fought to put them in power.

“I have no empirical evidence that President Banda has given instructions to endorse Kunda; it is just speculation and so I can’t vouch for that, speculation. However, you expect some gratitude from those people because, how did they come into authority in the party? Surely you expect them to show gratitude to the authorities that brought them into positions of authority,” Mulongoti said.

“It is expecting too much to expect them to show gratitude. It is precisely what we have been talking about. We must ask how those people who are alleged to be showing solidarity to the other gentleman Kunda came into authority in the party. Because of that I do not expect them to show disloyalty.”

Mulongoti said those in authority would risk inviting displeasure if they did not show neutrality, saying they would only earn respect if they did so.

“But if they show extreme bias because of that position they hold, it is going to have a backlash as well because a political party is a conglomerate of members who have independent minds,” Mulongoti said.

“And they also expect that the leadership which is there will serve them in an impartial manner and if you show partiality you create anger in those that are not benefiting from that partiality.”

Mulongoti said those in authority could take their loyalty to wherever they deemed fit but they should remember that the MMD belonged to all the members.

“And a decision will be made by the party officials at the convention,” he said.
Mulongoti said he was ready to defend democracy at any cost.

He said he did not mind losing at the convention because what mattered most was the defence of the principle of democracy.

Asked if he was ready to lose his ministerial job because of his defence for democracy in the ruling party, Mulongoti responded in the affirmative.

“Let me say this, Patson, you lose a job you find it. I lost it in 2000. I lost it; I found it again, right? So, losing the job is not the issue. It is the defence of the ideal of democracy that I am for,” Mulongoti said. “I do not think that when we defend democracy we must pay a small price. You can pay a big price. We are aware of that.”

He said he was a purchasing and supplies manager with a personal-to-holder vehicle when he went to Garden House at the formation of the MMD.

Mulongoti said he did not go there out of desperation, but on a matter of principle.

He said in 2000, he was the first minister to be dismissed by then president Frederick Chiluba when he opposed the third term bid.

“And this ideal is the one on democracy, and over that there is no compromise. And this is why when I stand up to say my motto is democracy forever, I mean exactly that because that is what I have stood for,” Mulongoti said. “And because of that, I am more than willing to go all the way in the defence of democracy.”

Mulongoti said he hoped the colleagues in MMD could see the values he cherished, especially if those values would lead to greater happiness of the people.

He said he would not withdraw the statement he recently made that without him and late Benny Tetamashimba, President Banda would not be President today.

“Well I said it. I don’t want to repeat it. I said it. Look, what I say is already said. So it can’t be withdrawn,” Mulongoti said.
Mulongoti said no matter which way one looked at the truth, the truth still remained.

He said intellectualism could challenge the truth, but it shall still stand.

“It is not a matter of being dishonourable, no. Those are historical facts. They are there. They will remain on record for years to come because they are facts…and we would like to be proud of our history, especially good history,” said Mulongoti.

According to President Banda, Mulongoti was among the first emissaries that late president Levy Mwanawasa sent to his Banda farm in Chipata to invite the former UNIP member to join the MMD and help Mwanawasa campaign for a second-term of office.

But well placed MMD sources revealed on Thursday that President Banda had in fact given a green light for provincial MMD executive committees to endorse the candidature of Kunda.

“The President wants Kunda to be the vice-president because he is more trustworthy than Mike Mulongoti. He fears that Mulongoti has an independent mind and a difficult person to control. That is why the endorsements for Kunda you are seeing from the provinces are not from without. The President feels electing Mulongoti might spell trouble for him,” the sources said.

“The endorsements have Presidential backing. The President has actually instructed people like Lusaka Province MMD chairperson William Banda to spearhead the campaigns for him and Kunda. The President in fact sent acting MMD national secretary Chembe Nyangu to go and offer solidarity when George announced his candidature at the Lusaka MMD provincial offices.”

The sources said in fact President Banda held a meeting with Vice-President Kunda and Nyangu, hours before he declared his vice-presidential candidature.

The sources said apart from having issues with Mulongoti’s loyalty, President Banda did not like the people he Mulongoti was working with like Mbita Chitala.

“Of course it is public knowledge that Mbita Chitala is eyeing the position of national secretary, and the President has issues with that. The President feels Mulongoti might want to come up with parallel structures,” the source said.

“The President wants the relationship he has enjoyed with George Kunda to continue at party level. But if you have heard statements from Mulongoti, he is always emphasising the need for democracy and that all those aspiring for positions should be allowed to do so without undue influence.”

The sources further revealed that foreign minister Kabinga Pande was initially interested in the vice-presidency but did not get a favourable response from the President.

The sources said chairperson for legal affairs Bwalya Chiti was among the many interested in the vice-presidency.

When contacted over the issue, Pande, who is MMD deputy national chairman, said he will announce the position he would contest for tomorrow.

Chiti also refused to comment on the matter, saying he would announce at the right time.

The sources disclosed that Zambian High Commissioner to Malawi Major Richard Kachingwe was seriously considering abandoning the diplomatic duties to contest the position of national secretary.

“We also know that education deputy minister Boniface Kawimbe will challenge Michael Mabenga for the position of national chairman,” said sources.

And former Presidential affairs minister Webby Chipili said he would challenge education minister Dora Siliya for the position of party spokesperson.

Chipili, who was earlier interested in the vice-presidency, said he had now settled for the position of party spokesperson because he was better suited for it.

He said he wanted to facilitate information flow between the grassroots and the top leadership, an ingredient he felt was missing.

GOVERNMENT leaders need to tighten their belts to indirectly cushion the salaries of the poor, says Bishop Paul Mususu.

In an interview yesterday following the recently announced K419,000 as minimum wage for non-unionised workers, Bishop Mususu advised government leaders to trim costs in the interest of poor workers.

“It is unfortunate that when these people think of the poor, they don’t lower themselves to the levels of these people,” said Bishop Mususu who is former Evengelical Fellowship of Zambia executive director.

Bishop Mususu said the minimum wage was not adequate and needed to be adjusted.

He said the common sense that people needed to bear in mind was the Basic Needs Basket (BNB) which indicated that the cost of living for a family of six in Lusaka was above K2 million.

“We need to be sympathetic with the poor and that’s why I am saying certain things that are enjoyed by the leaders in government should be curtailed to indirectly push certain amounts to the poor,” he said.

Bishop Mususu said the reality on the ground was that the current wage was not enough and added that this could not be disputed.

The government recently announced an increment in the minimum wage for non-unionised workers from K268,000 to K419,000, with the wage for domestic workers being increased to K250,000.

But on Thursday, Caritas Zambia said it will be tough for the country to attain the Millennium Development Goals (MDGs) on poverty with the set minimum wage of K419,000.

Caritas Zambia’s unit head for development Martin Sampa said despite the increase of the figure from K268,000, a good number of citizens in the country were still living below the poverty datum line.

He said the government should tie the minimum wage issue to the Jesuit Centre for Theological Reflection (JCTR) Basic Needs Basket (BNB) which was now around K3,000,000 for a family of six in Lusaka.

UPND maybe hiding its true intentions about the Pact, says PF secretary general Wynter Kabimba.

Reacting to UPND secretary general Winstone Chibwe’s letter dated February 17, 2011, which was published in the Zambia Daily Mail yesterday, Kabimba - in his letter to Chibwe yesterday - stated that the UPND deliberately chose to misinterpret everything that his Thursday press statement contained.

“I would like to acknowledge receipt of your letter dated 17th instant which letter was a rapid response to the PF press briefing held at the PF secretariat on the same day. It is unfortunate that you have deliberately chosen to misinterpret everything that my statement to the press contained,” read Kabimba’s letter to Chibwe in part.

Kabimba stated that PF had not at anytime declared Michael Sata as the Pact presidential candidate.

“We communicated the PF’s acceptance of proposals made to us by your member Professor Clive Chirwa. As I said to your president when he called me, I did not go looking for Prof. Chirwa. He came to me from your party,” Kabimba stated.

“I am aware that after the discussion with us he came back to brief your party. Our understanding of the UPND reaction to the Chirwa proposals both by the UPND president and his senior colleagues as contained in your letter and the press is that none of those proposals appeal to the UPND as a basis for discussion under the pact.

“According to paragraph 4 of your letter UPND is mainly concerned with ‘…fundamental social economic and governance issues that we in the UPND believe and still believe must come first before even contemplating the issue of presidency…’ what is surprising to us as PF is that the Chirwa proposals contain this very item of fundamental priority to the UPND. By PF accepting this proposal in the Chirwa document means acceptance of the UPND proposal of divine importance.

“Where then is the mischief which you loudly attribute to me? How does this constitute lack of maturity and seriousness on my part as you put it in your letter? What is indecent about PF or as you seem to suggest that it is Wynter Kabimba as an individual doing this behind PF in saying that the Chirwa package forms a good basis for the JNC meeting? Your lack of civility and even sobriety in the tone of the language of your letter and the press statements which followed would clearly show any reasonable person or reader that UPND may be hiding its true intentions about the Pact.”

Kabimba stated that he had been involved in political pacts and even mergers in the past.

“I am, therefore, experienced in determining the true spirit and intentions of parties in such an arrangement. I have in the past held several meetings with senior members of UPND all in a bid to ensure that the Pact succeeds to form an all inclusive government for the people of Zambia,” Kabimba stated.

“This is the information you have as UPND conveniently decided to withhold from the general public about my commitment to this cause. What I have refused to accept is that I should belong to a political party on ethnic, religious or other leaning. Such a doctrine offends against my personal character and beliefs.”

In his letter to Kabimba, which was also published in the Zambia Daily Mail, Chibwe stated that the proposals were Prof Chirwa's personal views. He stated that it was important to show maturity and seriousness in the handling of the vital national exercise.

He stated that their last letter to Sata dated January 20, 2011 had an enclosure of the UPND press statement that contained fundamental social economic and governance issues that the UPND believed and still believe must come first before even contemplating the issue of presidency.

Johannesburg - A South African businessman accused of threatening to unleash biological weapons on Britain and the United States may have been driven by concern over the plight of white farmers in neighbouring Zimbabwe, a spokesperson for the prosecution said on Monday.

The suspect, Brian Roach, did not have the means to carry out his threats to spread foot-and-mouth disease, National Prosecuting Authority (NPA) spokesperson Mthunzi Mhaga said.

Roach, 64, who owns an engineering firm outside Johannesburg, appeared in court on Monday after his arrest on terror charges on Saturday. The case was postponed until Friday for a bail hearing.

Roach threatened in letters and e-mails sent to the British government to spread the disease in Britain and the United States unless he was given $4m.

Plight of white Zimbabwean farmers

"We have the expertise and resources to do this very effectively and will be able to devastate the industry in the UK which will cost billions to the economy," Roach wrote in an e-mail to the British government. "We will devastate your farms and then we will then take the problem to your co-conspirator the USA."

Roach appeared to believe the US and Britain should do more to help white Zimbabwean farmers, Mhaga said.

About 4 000 white farmers have been forced from their farms since 2000 a campaign to put more land in the hands of impoverished blacks.

Roach said he wanted compensation for losses incurred by Zimbabweans because of the US, which he said influenced the situation in Zimbabwe with only its "own interest at heart".

On October 6, Roach wrote in an e-mail: "We are not habitual criminals but have been victim of a situation which was entirely out of our control and attributed to corrupt and incompetent politicians."

Violence in Zimbabwe has surged since January, when Mugabe called for elections later this year to bring Zimbabwe's troubled coalition to an end. The power-sharing government - a joint coalition of Mugabe and Morgan Tsvangirai, the formal opposition leader - took office February 11, 2009 after disputed elections plagued by violence and allegations of vote rigging in 2008.

Police said a six-month terror investigation by South African, British and US officials culminated with Roach's arrest. US and British officials confirmed they had worked closely with the South Africans.

'Very serious threat'

"This biological agent, if deployed, would have caused the destruction of property and resulted in major economic loss," a police statement said. "This was therefore regarded as a very serious threat."

Police charged Roach with terrorist activity and money laundering. The grey-haired man, married with four grown children, appeared briefly in court on Monday, wearing glasses and a black fleece jacket.

Police said Roach made the threats repeatedly in letters and e-mails sent from internet cafes.

Police searched Roach's home and other sites, but found no evidence he would have been capable of carrying out his threats.

Cape Town - Two suspects implicated in the murder of Anni Dewani claim that he was beaten up by police and told what to say, their lawyers have told British newspapers. The Swedish woman’s husband, Shrien Dewani, has been accused by Mziwamadoda Qwabe, Zola Tongo and Xolile Mngeni of plotting her murder.

Tongo, who was the taxi driver for the couple who were in Cape Town for their honeymoon in November, entered into a plea deal with the State for his part in the murder plot.

In return for a lesser sentence, Tongo gave a statement to the police stating that Shrien Dewani plotted his wife’s murder. Tongo claimed that he hired Mngeni and Qwabe to take Anni Dewani out.

In January, Qwabe confessed to having taken part in a “staged hijacking”.

‘Beaten into confessing’

But now Qwabe’s lawyer, Thabo Nogemane, has claimed that detectives “suggested” to him what statement he should make.

Nogemane told the Daily Mail in the UK that after being arrested, his client was first assaulted by detectives then instructed on what to say in his “confession”.

Qwabe’s disputed “confession” is understood to be one of the main pieces of evidence linking Dewani to the murder of his wife.

Nogemane, told Britain’s The Guardian: "I am instructed that some unknown police officer assaulted him by means of a big torch. He was hit all over his body. The police in South Africa only hit in such a way that there are no marks, no evidence.

"He said the statement was a suggestion put to him by the police. They already had the allegations so they told him: 'Just sign here'. I wouldn't refer to it as a confession, just a statement."

Nogemane claimed Qwabe had an alibi. "They [the police] were under pressure; they had to act quickly and get information. They arrested the wrong people."

‘Suffocated, punched’

Vusi Tshabalala, Mngeni's lawyer, told the Guardian that his client had also been abused: "In the process of interrogating him, police would physically assault him with fists and use a plastic bag to suffocate him. He was frightened. He was angry."

Tshabalala believes the police used "irregular methods" because they were under pressure to solve such a high-profile crime.

Dewani, 31, is set to appear in a British court in May for his next extradition hearing.

He insists that he is innocent and should he return to South Africa, will receive an unfair trial.

His claim is given weight by the fact that South African police boss General Bheki Cele called Dewani a “monkey” who “came all the way from London to murder his wife here”.

Dewani has missed his last two extradition hearings in London, claiming that the stress has made him too ill to pitch up in court.

PF has accepted UPND chairperson for international relations Professor Clive Chirwa’s proposals over the pact. Addressing journalists at the PF secretariat yesterday, PF secretary general Wynter Kabimba, who was flanked by vice-president Dr Guy Scott and national chairperson Inonge Wina, assured the public that the Pact was still in existence.

“In June 2010, the PF and UPND celebrated the first anniversary of the establishment of the PF/UPND pact. Since then there has been a great deal of anxiety and concern amongst PF and UPND members and the general public regarding the impetus of the Pact,” Kabimba said.

“We continue to receive queries from members of the press as to whether or not the Pact is still in existence. I would like to take this opportunity today on behalf of the PF to inform the public that the pact between the PF and UPND is still alive and viable as an alternative government to the MMD during this year’s tripartite elections.”

Kabimba said the PF had received from UPND fundamental proposals regarding the Pact.

“These proposals, which were received through the UPND chairman for international relations Professor Clive Chirwa are as follows: (i) that the two political parties should design and agree on a common manifesto or social and economic development agenda in government, (ii) that the two parties share constituencies with the PF taking 60 per cent of the parliamentary seats and the UPND 40 per cent of the seats,” Kabimba said.

“(iii) that Mr Michael Sata be the Pact presidential candidate in the 2011 presidential and general elections and Mr Hichilema to be the vice-president in government, (iv) that the Cabinet portfolios be shared with PF taking 60 per cent and UPND 40 per cent, (v) that these proposals should be embodied in a document to be signed by the two leaders at a ceremony to be witnessed by NGOs, the Church and other concerned stakeholders.

“In our desire to ensure that the Pact makes progress and in order to show our commitment to the PF/UPND pact, we hereby accept these proposals within the working time frame attached to them. I have accordingly written to the UPND secretary general. Let me take this opportunity once again to thank all of you for your unwavering support which you have so far rendered to the Pact since June 2009.”

And in his letter dated January 16, 2011 to UPND secretary general Winstone Chibwe, Kabimba stated: “Dear Sir, Re: UPND proposals. I am in receipt of the UPND proposals through Professor Clive Chirwa, chairman for international relations dated 15th February 2011, a copy of which I have enclosed herewith for your easy reference. In order for the Pact to make progress we hereby accept the proposals for our JNC meeting which we should convene soonest to complete the details thereof.”

IT is ideal for foreign investors to keep their money in local banks, says Ambassador Love Mtesa. In an interview, Ambassador Mtesa who is also Consumer Unit and Trust Society Zambia chapter board chairperson, said government should renegotiate with foreign investors to ensure that they bank their money locally.

Ambassador Mtesa said foreign investment in the country was good for the economy but that it would help to negotiate with the investors to bank with local banks.

“We need to look at the agreement because if foreign investors were banking with our local banks it would make the economy grow faster because some of the money will be used in the country,” Ambassador Mtesa said.

He said it was sad that all the money that foreign investors were making was going abroad, with the country benefiting nothing.

He said such kind of a situation was making it difficult for the government to plan for economic growth as it did not know what to expect from investors.

“It is necessary for both investors and government to sit down and look at possible ways of banking with local banks,” he said.

Ambassador Mtesa added that some foreign investors were making huge profits that would benefit the local economy through bank loans.

“They can agree on a percentage of how much money should be banked locally and how much be taken to their countries. Government should ensure that the economy grows from foreign investment,” he said.

Ambassador Mtesa said it was up to the government to ensure that the Zambian people started benefiting from foreign investment.

He recommended that government and foreign investors find a lasting solution in ensuring that some of the profits made should remain in Zambia.

Ambassador Mtesa said it was not necessary for investors to keep all their money abroad when the country had enough banks.

FRA has so far exported over 160,000 metric tonnes of maize to four neighbouring countries. The agency says it expects to sell about 500,000 metric tonnes of maize this year owing to the bumper harvest recorded in the last farming season.

According to public relations manager Mwamba Siame, the agency as at February 11, 2011 had sold over 180,500 metric tonnes of maize valued at over US$30.6 million.

“Prospects on the market are looking bright and it is projected that the Agency may sell up to 500,000 metric tonnes by the end of the year,” she said.

Siame said exports accounted for the large percentage out of the total volumes of maize sold.
“Exports accounted for 163,600 metric tonnes while19, 960 metric tonnes were sales on the local market,” she said.

Siame said most of the maize had been exported to Zimbabwe which accounted for over 70 per cent of the sold quantities.

“Twenty-five per cent went to Democratic Republic of Congo while the Mozambican and Namibian markets purchased one per cent each. Although the quantities for the DRC market are smaller in terms of volume, there has been an upsurge of activity in the recent past. Similarly, the Zimbabwean market has recorded scaled up volumes and payments during the same period,” she said.

Siame said the agency had so far made commitments in terms of maize contracts totalling 320,132.39 metric tonnes which is yet to be paid for and uplifted by clients.

THE suspension of a licence for Frederick Chiluba's UK-based lawyers is confirmation that President Rupiah Banda directed the Zambian judiciary to acquit the former president and his colleagues of corruption charges, says Ludwig Sondashi.

Commenting on the suspension of the practicing licence of Mohammed Iqbal Meer by the Solicitors Regulatory Authority in the United Kingdom over his dealings connected to alleged abuse and misappropriation of Zambian public resources, Dr Sondashi called for reduction of presidential powers to avoid the recurrence of what happened in the handling of former president Chiluba's cases where he said President Banda facilitated his acquittal.

"He Chiluba was let free because of the President. The President here dictated to the Judiciary," said Dr Sondashi, a Lusaka-based lawyer. "But I cannot just end there, what we should do in Zambia is to fight that presidential powers must be reduced. That way he will not be able to interfere with the judiciary."

Dr Sondashi said Zambians must not keep on complaining but act to change the laws. He said without reforms on presidential powers, Zambians would just be shooting in the dark.

"We should all aim at divorcing the President from being partisan because if the President continues to be the head of state and head of government, then we are not going to put everything right," said Sondashi.

"The problem here is that as long as you allow the President to be a player in the political field, then these things will not change. The President will continue interfering with the judiciary, parliament, elections, the police and so forth. The President should be above politics."

Mohammed Iqbal Meer is a second lawyer to have his practicing licence suspended over Chiluba's corruption cases.

PRESIDENT Rupiah Banda says the MMD will be blamed if there is no peace in the country during this year’s elections. Speaking at Livingstone International Airport upon arrival yesterday to officially open the nutrition consultative forum at Zambezi Sun Hotel, President Banda said the nation had entrusted the MMD with peace, hence the need to maintain it.

President Banda said there was need to allow delegates to elect leaders of their choice at the forthcoming MMD convention scheduled for April.
He said the convention should not divide the party.

“Let’s do it campaigns in a decent manner. Let’s not insult each other. Let’s ensure we come out of the convention more united,” President Banda said.
He said democracy should be allowed to prevail.

President Banda said the MMD needed to work hard to ensure that it had more members.

“The elections are around the corner and we are going to require the zeal and appetite to campaign,” he said.

President Banda said he would camp in Livingstone during the Southern Province campaigns ahead of the tripartite elections.

President Banda said the campaigns this year would be interesting.

And Southern Province MMD chairman Edgar Keembe said the party would not attract people if it were not united.

Keembe said unity was the only thing that could take the party ahead.
He said the party did not want hired people to destabilise the nation.

He also said the people of Southern Province wanted to work with the MMD.

“If there is anything that the people of Southern Province dread, it’s cobras. Anything associated with the cobras, abash! We will ensure that MMD goes through,” said Keembe.

A lawyer for the 23 Lozis charged with treason over the Barotseland Agreement of 1964 says the Director of Public Prosecutions (DPP) is violating their rights. Dr Rodger Chongwe said in the Lusaka Magistrate’s Court when the group appeared for mention yesterday morning that the rights of the treason detainees had been violated with impunity.

And the state has entered a nolle prosequi in a case where a Kalabo police officer Siyamana Namate and a Mongu businessman Reuben Aongola were charged with treason.

Dr Chongwe is one of the lawyers representing Muya-ngana Muyangana and 21 others who are jointly charged with treason and a police officer from Chelstone Police Camp, Maybin Sikwa who is charged separately for the similar offence.

When the matter came up before magistrate Kenneth Mulife because principal resident magistrate Sharon Newa, the magistrate handling the case was not available, a public prosecutor Mwewa Musonda told the court that the case was coming up for mention awaiting a certificate of committal to the High Court from the DPP.

But Dr Chongwe said he was aware that magistrate Mulife was standing in for magistrate Newa to mention and adjourn the case.

“However, this is the only court which these accused can address,” Dr Chongwe said.

Dr Chongwe said the accused persons were born free men.

He said under Article 13 of the Zambian Constitution, the accused having been detained on an allegation of committing a criminal offence against the state, it was the state’s obligation to take them to court for trial not within one month but within reasonable time.

He said the accused had been detained for more than one month.

Dr Chongwe said there was neither a state of emergency declared under Article 1 in the country nor a partial state of emergency declared in Mongu.

“There is peace in Western Province and there is peace in Mongu, the DPP can’t detain citizens of a country indefinitely under the pretext that he is still investigating the case,” Dr Chongwe said.

He said people should be arrested after investigations of their alleged criminal acts had been finished and that is when the DPP should issue a certificate of committal.

He said the treason-accused Lozis have been held in custody against Article 13 (3) which state that a person who is arrested or detained upon reasonable suspicion that he committed a criminal offence in Zambia and who is not released should be brought without undue delay before court.

“We don’t leave in a state of anarchy, these men have committed no offence, the charge is fake, that’s why the DPP instead of complying with the law, he is detaining these men unlawfully,” Dr Chongwe said.

Dr Chongwe said they were concerned with the violating of the liberty of Zambians by the DPP.
“He DPP has no regard for freedom and liberty for people of this country,” he said.

Dr Chongwe requested the courts to consider the issues he had raised.

In response to the defence’s concerns, Musonda said the state sympathised with the accused persons especially that the offence was not bailable.

However, he said the state was also aware of the Constitutional powers of the office of the DPP which functioned independently.

“The state can only go as far as submitting a docket which we have done and we are waiting for a certificate of committal to the High Court,” Musonda said.

He proposed that the case be adjourned to February 25, 2011 for mention and that in the case that a certificate of committal was not received, dates for preliminary trial would be set.

Ruling on the submissions, magistrate Mulife said he had anxiously heard the submission from both parties.

He said the concerns were quite valid and agreed that the accused had been remanded for quite some time.

Magistrate Mulife said since he was not the one presiding over the case, he had noted on record the strong sentiments and he would direct them to the presiding magistrate.

Another defence lawyer Muleya Kashewe urged the court to include Sikwa who is separately charged when a ruling is made on the 22 accused Lozis.

Just after magistrate Mulife adjourned the cases to February 25, a daughter to one of the accused cried uncontrollably as her relatives were seen comforting her.

Earlier before senior resident magistrate Aridah Chulu, the state entered a nolle prosequi in respect of Namate and Aongola.

Public prosecutor Mwewa Musonda told magistrate Chulu that he had received instructions from the DPP to discharge Namate and Aongola.

Magistrate Chulu told the duo that they had been discharged under section 81 (1) of the Criminal Procedure Code CPC.

“Accused persons, you go home but this is not an acquittal,” said magistrate Chulu.

Good leaders must be interested in the welfare of those in distress. And in the run up to this year’s elections, we should demand that all those who are aspiring for public office tell us how they are going to deal with our country’s tragedy of unemployment. We expect them to feel the distress of many of our people who are unemployed. Unemployment is today a scourge in our country. It deprives our people of their God-given right to work. It undermines their human dignity. It is a terrible frustration and humiliation for a parent to be unable, due to unemployment, to provide for the family.

It is equally demoralising for young people to find there is no work waiting for them when they leave school, college or university. We therefore can’t leave this issue to chance. We know, and no one can cheat us, that the problem of unemployment is a difficult one for any government to face. But to solve it, we need hardworking and public-spirited politicians in government, in Parliament and in our councils. We need people of courage who will defend the truth and demand justice for all.

Everyone has the right to work. And the right to work imposes an obligation on those in government, in Parliament and in our councils to design policies that promote full productive and freely chosen employment. They are required to work hard and ensure that there is work for all who are available for and seeking work. And such work should be as productive as possible.

And this right, the right to work, is increasingly becoming important in our country because our government has continued to withdraw from the provision of basic services in many areas of human endeavour, leaving these to market forces and non-governmental actors.

The path towards the enjoyment and exercise of the right to work requires a critical analysis of our economic structures and how they lead to the problem of unemployment.

And it shouldn’t be forgotten that there is more to the issue of employment than just its economic and social costs, severe as they are in our country today. Employment concerns not only the economy but also, and especially, personal values. Employment is rooted in respect for human dignity.

The effect of unemployment is degrading and making employment available is most important. We are all called to use our talents through our employment in order to build the good of our society. If others are denied this opportunity, society cannot develop. Employment provides an opportunity for each of us to show our humanity. The right to employment should be construed against the conceptual background of the meaning of work. Other than being a means to livelihood, work expresses and enhances a person’s dignity.

Even if unemployment did not impact negatively on our economy, and even if it was not a cause of social problems, it would still be a denial of an essential element of human dignity. We say this because through employment, we co-operate with the Creator in bringing to fulfillment the created world; we exercise our God-given abilities and talents as co-workers with God in the great task of transforming the material world.

Employment is not simply an onerous necessity, coincidental with our physical existence, a burden which we should try to escape. It is a vital part of our humanity, the manifestation of our creativity, an opportunity for our growth and fulfillment. Indeed, work is nothing less than a constituent dimension of the purpose for which the world was created and for which we ourselves were brought into being.

What is needed, therefore, is not just employment, but humane and dignified employment. Nevertheless, we are concerned for the present purposes with the need for work itself to be available to all our people, work which however humble or exalted it may be, satisfies our innate desire and responsibility to reach fulfillment. That so many of our people are denied this opportunity is a shameful injustice, especially since it is so often the result of excessive pursuit of profit or of economic policies which fail to take adequate account of the inherent value and dignity of the human person. Work is indeed a right, a right which, as a nation, we fail to respect at our own peril.

In this regard, it is disturbing to note the current tendencies to lay the blame for unemployment at the door of the unemployed themselves. The oft-repeated charge that our people are unemployed today because of the high wages they demand without commensurate increases in productivity is responsible for the inability to create more employment. It is a lie. We have many skilled and highly trained people who are on the streets. And those who are highly educated and experienced don’t like to be known as being unemployed, they would rather refer to themselves as consultants. We have many people with post-graduate degrees in this country who have no jobs, who are unemployed. And this is not because they are looking for very high salaries. In many cases, this is simply because the owners of capital have brought with them their own employees at the expense of our people. It is not unusual to see even labourers being brought in from the home countries of capital. And those who try to question this are denounced by our government and accused of frustrating foreign investment and scaring away foreign investors.

Clearly, the issue of employment should be topmost on our campaign issues for this year’s elections. Every candidate and their political parties should be taken to task on the issue of employment because it is at the centre of our people’s dignity. And as Dr Mutumba Bull has correctly observed, our country faces a huge challenge of creating jobs for the many unemployed citizens, especially the youth. The challenge is how our political leaders, with the support of our people, are going to create jobs. For this reason, this year’s elections should be about tackling unemployment. And only those leaders who are seen to have a commitment and a convincing way of tackling the issue of unemployment deserve our people’s votes. There is no need to waste our vote on candidates who are not interested in the common good and are just obsessed with power.

ZAMBIA faces a big challenge of creating jobs for the many unemployed youths, says Dr Mutumba Bull. In an interview, Dr Bull who is an academician and a veteran politician said there was so much unemployment in the country, especially among the youth.

She said this was a big problem and the challenge was how the country was going to create jobs. Dr Bull said it was through economic development that jobs would be created for more Zambians to become entrepreneurs. She said this would ensure that profits did not fly out of the country.

“Let’s put our heads together to try and resolve these problems. Without growing industries, the informal sector has become an escape sector. Let us try to grow into something bigger and see how we can improve on that,” she said.

And Dr Bull said it was very critical that Zambia fought corruption because all the progress and stability recorded so far could be defeated. She said corruption was a negative vice that needed to be controlled. Dr Bull said there was now more knowledge about corruption unlike in the past and this had helped people understand what it was and what was needed to do.

Meanwhile, Dr Bull said it was the right of women to participate in electoral process and be elected as office bearers.

“It is their birth right; I just regret that up to now, we have not been able to see a large number of women in these positions. Let them take the challenge. I am aware that there are certain factors that keep women away from active participation so maybe some interventions are necessary by the state to promote more women,” she said.

Dr Bull said women were needed because the needs of the nation were many and varied and could be addressed better when both men and women worked together. She said Zambia had failed to reach the 30 per cent SADC benchmark of women in decision making and African Union’s 50 per cent.

(NEWZIMBABWE) Zimbabwe: European Union sanctions list

COMMENT - This is the list of economic sanctions against Zimbabwe by the EU. This should not be confused with the credit freeze that was put on the country of Zimbabwe through the Zimbabwe Democracy and Economic Recovery Act of 2001 (Section 4C titled Multilateral Financing Restriction). However, it is clear that even this list of 198 individuals and 31 parastatal organisations, or owned by ZANU-PF friendly white indivduals - John Arnold Bredenkamp and Billy Rautenbach - president Mugabe's wife and minister Kasukuwere, are obviously going to have the effect of economic sanctions, whether the EU wants to 'frame' it that way or not.

These however are not the economic sanctions that destroyed the Zimbabwean currency and economy in the year 2002 - those are in Section 4C of ZDERA of 2001.
